1.1 Nature of Services

BETTY JET IS A FUEL BROKER AND INTERMEDIARY, NOT A FUEL SUPPLIER OR DISTRIBUTOR.

We facilitate and coordinate fuel services between customers and third-party fuel suppliers, refiners, distributors, airports, fixed-base operators (FBOs), and other service providers. We do not:

• Own, operate, or control fuel storage facilities, refineries, or distribution networks
• Physically deliver, pump, or handle fuel products
• Manufacture, refine, or produce fuel
• Employ fuel truck drivers or into-plane fueling personnel
• Control the quality, specifications, or properties of fuel products
• Guarantee the performance or reliability of third-party suppliers

Our role is limited to: arranging and coordinating fuel services, facilitating communication between parties, processing orders and payments, providing customer service and support, and maintaining business relationships with suppliers.

1.2 No Guarantees or Warranties

BETTY JET MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING:

• Service Availability: Fuel availability at any specific location, ability to arrange services at requested times, supplier or FBO participation, access to airports or fueling facilities
• Service Quality: Quality, grade, or specifications of fuel, performance or reliability of suppliers, timeliness of delivery or fueling, professional conduct of third-party personnel
• Accuracy of Information: Pricing, rates, or quotes, fuel specifications or technical data, location information or facility details, availability or operational status
• Business Outcomes: Cost savings or competitive pricing, meeting your specific requirements, preventing delays, cancellations, or disruptions

2.1 Independent Third Parties

ALL FUEL SUPPLIERS, DISTRIBUTORS, AIRPORTS, FBOs, AND SERVICE PROVIDERS ARE INDEPENDENT THIRD PARTIES OVER WHOM BETTY JET HAS NO CONTROL.

We do not employ or supervise third-party personnel, control third-party operations, policies, or procedures, guarantee third-party performance or compliance, or bear responsibility for third-party actions or omissions.

2.2 Third-Party Liability

BETTY JET IS NOT LIABLE FOR ANY ACTS, OMISSIONS, NEGLIGENCE, MISCONDUCT, OR FAILURES OF THIRD PARTIES, INCLUDING:

• Fuel suppliers failing to deliver or delivering late
• Suppliers providing incorrect fuel grades or contaminated fuel
• FBOs denying access or imposing restrictions
• Equipment failures or malfunctions
• Personnel errors or safety violations
• Damage to aircraft, vehicles, or property
• Environmental contamination or cleanup
• Breach of contract by suppliers

2.3 Supplier Selection

While we endeavor to work with reputable suppliers and service providers, we do not guarantee or warrant their qualifications, safety records, or reliability. We are not responsible for verifying supplier credentials, insurance, or compliance, and we are not liable for supplier selection or performance. YOU ASSUME ALL RISKS ASSOCIATED WITH THIRD-PARTY SERVICE PROVIDERS.

3.1 Quote Accuracy

FUEL QUOTES AND PRICE ESTIMATES ARE SUBJECT TO CHANGE WITHOUT NOTICE AND ARE NOT BINDING UNTIL CONFIRMED IN WRITING.

Pricing may fluctuate due to market conditions and commodity prices, supplier pricing changes, taxes, fees, and regulatory charges, location-specific costs, volume and delivery requirements, time of service (after-hours, weekends, holidays), and fuel type and specifications. Quotes are typically valid for 24-48 hours only and may expire sooner during volatile market conditions.

3.2 Additional Fees

Final charges may include additional fees not reflected in initial quotes, including but not limited to: airport fees, FBO facility fees, security fees, after-hours premiums, standby time charges, trip charges or minimum delivery fees, fuel surcharges, environmental fees, credit card processing fees, cancellation fees, and late payment fees.

4.1 Fuel Quality

FUEL QUALITY IS THE SOLE RESPONSIBILITY OF THE FUEL SUPPLIER, REFINER, AND DISTRIBUTOR, NOT BETTY JET.

While fuel typically meets industry standards, we do not test, inspect, or certify fuel quality. We do not guarantee specific fuel properties or specifications and are not liable for fuel contamination, defects, or quality issues.

4.2 Safety Compliance

YOU ARE SOLELY RESPONSIBLE FOR: following proper fueling safety procedures, ensuring bonding and grounding during fueling, preventing fire and explosion hazards, supervising fueling operations, following OSHA and workplace safety regulations, ensuring proper equipment and storage, preventing spills and environmental contamination, using appropriate personal protective equipment, and training personnel on fuel handling.

4.3 Environmental Compliance

You are responsible for complying with environmental laws and regulations, preventing spills, leaks, and contamination, proper waste disposal and cleanup, reporting environmental incidents as required by law, and maintaining spill response equipment and plans. We are not liable for environmental damages, cleanup costs, or regulatory penalties.

Betty Jet does not provide flight planning or dispatch services, offer aviation safety or operational advice, verify pilot qualifications or aircraft airworthiness, control flight operations or decisions, or guarantee fuel availability for emergency situations.

WE ARE NOT LIABLE FOR ANY DAMAGE TO AIRCRAFT INCLUDING fuel system damage or contamination, engine damage, corrosion, paint or exterior damage during fueling, electrical or avionics issues, structural damage, or any consequential or indirect damages. Aircraft owners and operators bear all risk of aircraft damage regardless of cause.

Betty Jet primarily operates in the United States, with focus on Florida and surrounding regions. For rural, remote, or off-grid locations, additional limitations may apply including higher costs, extended delivery timeframes, limited supplier availability, access restrictions, and weather dependencies. Service to remote locations is subject to greater uncertainty and risk.

BETTY JET SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: reliance on website content or information, acting on quotes or recommendations, service interruptions, system outages, third-party supplier failures, airport or FBO restrictions, government actions, force majeure events, lost profits or business opportunities, aircraft damage or total loss, personal injury or death, property damage, or environmental contamination.

BY USING BETTY JET'S SERVICES, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS including operational risks (fuel availability, supplier performance, pricing fluctuations, delivery delays), safety risks (fueling hazards, contamination, fire and explosion risks), financial risks (price changes, cost overruns, payment risks), and legal risks (compliance violations, liability for damages, contractual disputes). YOU ACCEPT THESE RISKS AND AGREE TO HOLD BETTY JET HARMLESS.
